- Please note, water sports activities are reliant upon weather conditions. If weather conditions are not suitable, lessons/courses/clinics may need to be rescheduled at late notice. If you cannot attend a lesson that has been rescheduled we will attempt to make arrangements that suit both parties.
- Gift Vouchers are non refundable and are non transferable. Gift Vouchers are valid for 6 months from date of purchase. All students are to be fully aware that all water sports lessons/courses/clinics are weather dependent. The decision to cancel a lesson due to safety or extreme weather concerns rests solely with the instructors. In the event of KiteWest cancelling the lesson/course/clinic an alternative lesson/courses/clinics will be rescheduled at no cost to the student if the lesson/course/clinic has already been paid.
- Your personal information collected by KiteWest Watersports is protected by the Privacy Act 1998. KiteWest uses your personal information when scheduling your lesson/course/clinic/tour or in the event your emergency contact needs to be contacted. Your personal information is not used for commercial purposes and is not distributed to any other organisation for any purpose.
- KiteWest Watersports makes every effort to provide services (lesson/course/clinic/tour) as booked; there may be occasion beyond our control where alternatives have to be arranged due to unforeseen circumstances. We will make every effort to provide equivalent or superior service but can make no guarantee of this.
- During your water sports lesson/course/clinic or whilst on a tour, your personal belongings are your responsibility; we are not liable for loss, damage or repair. When booking a kitesurfing tour personal travel insurance is highly recommended.
- KiteWest Watersports waiver form has been produced to set out the range of responsibilities and limitations entailed on the instructor’s and student’s behalf when partaking in certified IKO Kiteboarding lessons/courses/clinics or tours. It is a legal document which must be read, understood and signed prior to commencement of any supervised water sports activities including but not limiting to lessons/courses/clinics and kitesurfing tours activities.
- KiteWest Watersports and its instructors are responsible for conducting a thorough site analysis prior to commencing any lessons/courses/clinics or tours on a nominated location, provide no less than the minimum required Personal Protective Equipment (PPE) for its students and ensure that all equipment is in working order prior to commencement of lessons/courses/clinics and tours. It is the instructor’s responsibility to deliver all information relevant to the water sports activity with regards to the weather reading, wind effect, risk assessment, rules of the beach, safety and emergency procedures. It is also the instructor’s responsibility to ensure that a student has acquired competency in all steps of progression before advancing any further through a lesson/course/clinic or tour downwinders.
- When renting kitesurfing/wing foiling equipment and at any time during the rental period, KiteWest Watersports is not responsible for any accident/injury to third party/damage to rental equipment (including third party equipment or personal property). The person engaged in the kitesurfing/wing foiling rental equipment is fully responsible for any financial compensation in case of damages caused to a third party (injury/equipment or personal property) and Kitewest (equipment or personal property).
- KiteWest Watersports and its instructors reserve the right to refuse any persons displaying behaviour, which would otherwise indicate signs of being under the influence of alcohol, drugs or any other explicit substance.
- KiteWest Watersports maintains a zero-tolerance policy on sobriety in question and refusal is non-negotiable. Instructors have full authority to terminate lessons/course/clinics or tour participation on the grounds of compromised safety of students, instructor, beach users and/or to the detriment of school equipment, including but not limiting to weather deterioration, third party intervention and/or acts of negligence. Negligence is defined as any act of non-compliance to previous warnings issued by the instructor. Inadmissible acts of negligence divide the instructor’s time unequally between other students and draw negative attention to the sport from the public eye. Mediation will cease upon witnessing acts of negligence and the lesson/course/clinic/tour will be terminated for individuals implicated in such matters of concern in which case, no refund will be given.
